Flekswork LLC ("Flekswork," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our employee scheduling software, platform, mobile applications, and website (collectively, the "Service"). This policy is incorporated by reference into our Terms of Service.

Account and Registration Information: When a Customer (e.g., an employer) registers for the Service, we collect information such as the company name, administrator name, email address, phone number, physical address, and payment information like credit card details.

Authorized User Information: A Customer may provide personal information about its Authorized Users (e.g., employees), such as their name, email address, phone number, and position or job function, to create profiles and build schedules.

Communications: If you contact us directly for customer support or other inquiries, we may receive additional information about you, such as the contents of your messages and any other information you choose to provide.

1.2 Information We Collect Automatically

Usage Data: We automatically collect information about your interactions with the Service, such as the features you use, the pages you visit, and the dates and times of your activities. This helps us understand usage patterns and improve the user experience.

Device Information: We collect information from the device you use to access the Service, including the hardware model, operating system and version, and unique device identifiers.

Cookies and Similar Technologies: We use cookies, which are small files transferred to your computer's hard drive, to help us remember certain information, keep track of site traffic, and understand your preferences for future visits. 1.3 Location Information

GPS and Geofencing Data: If a Customer enables location-based features, we may collect precise geolocation data from an Authorized User's mobile device. This information is used for features like verifying an employee's location when they clock in or out, or for geofencing reminders. Crucially, location data is only ever collected while an Authorized User is clocked in through the Service. The Customer is solely responsible for providing notice and obtaining consent from its Authorized Users for the collection of this data.

We use the information we collect for various purposes, grounded in providing and improving our Service. These purposes include:

To Provide and Maintain the Service: We use your information to operate the Service, process transactions, manage accounts, and send you service-related communications.

To Improve and Personalize the Service: We analyze how you use the Service to improve its functionality, develop new features, and personalize your experience.

To Provide Customer Support: Your information helps us respond more effectively to your customer service requests and support needs.

With Your Employer (Our Customer): When we provide the Service to your employer, we are acting on their behalf. Your employer (the Customer) owns and controls the data submitted to its account, including your information as an Authorized User. They can access, modify, or delete your data and manage your access to the Service.

With Third-Party Service Providers: We share information with third-party vendors and service providers who perform services on our behalf, such as payment processing, data hosting, and security. These providers are only given access to the information necessary to perform their functions and are required to keep the information confidential.

With Third-Party Integrations: If the Customer chooses to connect a third-party application (e.g., a payroll or HR system) to the Service, we may share information with that application to facilitate the integration. The use of your data by that third party is governed by their own privacy policy.

For Legal Reasons: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, or protect the personal safety of users or the public.

In a Business Transfer: If Flekswork is involved in a merger, acquisition, or sale of all or a portion of its assets, your information may be transferred as part of that transaction.

We implement a variety of security measures to maintain the safety of your personal information. We use secure servers, and all supplied sensitive information (like credit card numbers) is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our payment gateway providers' database, accessible only by those with special access rights who are required to keep the information confidential.

However, no electronic transmission or storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. You acknowledge that you provide your personal information at your own risk.

Our Service is not intended for or directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take steps to delete such information from our files as soon as possible.

Flekswork is based in the United States, and the information we collect is governed by U.S. law. By accessing or using the Service or otherwise providing information to us, you consent to the processing and transfer of information in and to the United States.8
